What Is Medical Malpractice?

Medical malpractice occurs when a medical care provider fails to do what a reasonably careful and similarly licensed medical care provider would have done in the same situation. For example, negligence can occur in a variety of situations, including: a surgical or anesthesia-related mistake during an operation; a delayed or incorrect diagnosis; a physician’s failure to obtain the informed consent of the patient before an operation or surgical procedure; improper treatment for the diagnosed condition; misuse of prescription drugs or a medical device/implant; wrongful amputation; and delivery mishaps.

Medical Malpractice Claims Typically Have Four Requirements That Must Be Proven:

  • a duty running from the defendant to the plaintiff
  • the defendant’s breach of that duty
  • damages sustained by the plaintiff
  • proximate causation of the damages by the defendant’s breach of duty

Do I Have A Case?

In simple terms, if you are injured by a procedure performed by a doctor – or – suffer damage because a doctor did not diagnose a condition or perform a procedure, you may have a medical malpractice claim. It is important to speak with an attorney who can evaluate your case to determine if you meet the requirements in order to submit a claim.

Medical malpractice has different statute of limitations rules than regular negligence. An individual only has a one year time period to bring a medical malpractice claim. However, the law recognizes that a person might not know he or she has a medical malpractice claim until several years after a procedure or examination. You have one year after you are aware or should be aware of an injury caused by medical malpractice to file a lawsuit.
